Management of negotiations

The management of contractual negotiations with Russian-speaking companies is particularly important for our clients. The features of these negotiations, in addition to the language aspects, mainly concern geographical distances and legislative, regulatory and currency provisions. International sales must comply with a whole series of technical aspects that have to be evaluated in the contract, such as: the export documentation, which must necessarily comply with both Italian legislation and legislation Russian and other countries of destination of the products / services, or the certification of the products.

The contracting parties find themselves making important choices with regard to the delivery of products, the terms of payment and any financing of the export credit. All these aspects have been examined several times by our expert legal consultants, and are the subject of a wide range of skills, which involves not only the technical aspects of bargaining, but also all the cultural variables that intervene in the definition of these aspects and which can , if not properly assessed, produce negative consequences in bargaining, jeopardizing the internationalization project. The legal system in force in Russia is completely different from the Italian one, also considering the fact that Russia does not participate in the European Union, and that, therefore, the aspects to be considered also include customs issues.

From a customs point of view, we can recall here that Russia joined the WTO in 2012, after negotiations that lasted 18 years, and since then the duties applied have undergone a considerable reduction, paving the way for the import and export of products and services from all over Europe, facilitating the development of a more modern and competitive industrial and commercial system, a situation that Italy has definitely taken advantage of. Membership of the WTO has brought a new wave of investment in income and expenditure destined to expand further, despite episodic political misunderstandings. We can remember, in particular, the Eurasian Customs Union among Russia, Belarus and Kazakhstan, considered the beginning of the integration among the countries of the CIS area. This is a political, economical and business integration that is similar to the one among the member states of the European Union. The Eurasian Customs Union constitutes an area of ​​free circulation of goods having common customs barriers.
